A sublease agreement for a tenant-owned apartment (bostadsrätt) regulates the relationship between the owner who is subletting the home and the subtenant moving in. It sets out the rent, responsibilities, move-in date, and other terms — so both parties know exactly what applies.

Important considerations

  1. Without consent from the housing association or the Rent Tribunal, you risk losing your right to the apartment. Always check this before signing.
  2. The rent in a subletting arrangement must be reasonable. Excessive rent can be reviewed by the Rent Tribunal, and you may have to repay the excess.
  3. The apartment owner remains responsible towards the housing association regardless of what is agreed with the subtenant. Damage or disturbances can still fall back on you.
  4. The deposit should be regulated clearly. Without written deduction rules, it can be difficult to retain money for damage or unpaid charges.
  5. Do not forget an inventory list if you rent out the apartment furnished. It helps protect you if there is a dispute about what was in the apartment at move-in.

Legal validity

A written sublease agreement is not a formal legal requirement in Sweden, but it is strongly recommended. Oral agreements are difficult to prove in a dispute.

The agreement does not need to be witnessed to be valid, and it may be signed physically or digitally. The important thing is that both parties sign and that the terms are clear.

Common scenarios

Living abroad

You are moving abroad for a year and want to sublet your tenant-owned apartment during that period. The agreement sets out the terms clearly and states that the subletting ends when you return.

Trial cohabitation

You want to try living with your partner but keep your apartment. By subletting it, you can generate income that partly covers the monthly fee while keeping the financial terms clear.

Frequently asked questions

Do I need permission to sublet my tenant-owned apartment?

Yes. You need either the housing association's consent or permission from the Rent Tribunal. Without permission, the association may terminate your right to the apartment.

How much rent may I charge?

The rent must be reasonable. As a main rule, you may charge an amount corresponding to your own cost (monthly fee and, where applicable, capital costs), plus a reasonable furnishing surcharge if the apartment is rented furnished — normally no more than 15%.

What happens if the subtenant causes damage?

You as the apartment owner remain responsible towards the association. The agreement does, however, allow you to deduct damage from the deposit and pursue the subtenant for compensation.

Can the subtenant stay after the agreed term?

No. The agreement ends on the end date without separate notice. If the subletting is to be extended, a written extension and possibly renewed permission are required.

Does the agreement need witnesses?

No. Witnesses are not required for validity. It is enough for both parties to sign, either physically or digitally.
