What this template does

A prenuptial agreement regulates which property shall be separate and which shall be marital property — in other words, what is divided equally in the event of a divorce. It gives both parties security and predictability regarding the finances of the marriage.

Without a prenuptial agreement, the default rule is that all property is marital property and is divided equally upon property division. With a prenuptial agreement you can decide for yourselves what should be protected — for example a business, a property or an inheritance.

When do you need this agreement?

You need this if…

Important considerations

  1. The prenuptial agreement must be in writing, dated and signed by both spouses to be valid.
  2. The agreement must be registered with the Swedish Tax Agency (Skatteverket) — without registration it has no legal effect.
  3. If you marry before the agreement is registered, the application must be submitted within one month of the wedding for it to apply from the beginning of the marriage.
  4. You can amend or revoke a prenuptial agreement by drafting a new one, which must also be registered with Skatteverket.
  5. A prenuptial agreement may be adjusted by a court if it is deemed unreasonable having regard to its contents, the circumstances at the time it was drawn up, or events that have occurred since.

Legal validity

A prenuptial agreement is legally binding when it meets the formal requirements of the Swedish Marriage Code (Äktenskapsbalken 1987:230): it must be in writing, dated and signed by both spouses, and it must also be registered with the Swedish Tax Agency (Skatteverket). Witnesses are not required.

Frequently asked questions

Can we draft a prenuptial agreement after the wedding?

Yes, you can draw up a prenuptial agreement both before and during the marriage. However, it must always be registered with the Swedish Tax Agency (Skatteverket) to be valid.

How much does it cost to register with Skatteverket?

The Swedish Tax Agency's application fee is currently SEK 275 and can be paid via Swish or by deposit to Skatteverket's bankgiro. The fee can also be paid in cash at the reception of certain Skatteverket offices — in Stockholm (Sundbyberg), Gothenburg and Malmö. Can we change the prenuptial agreement later?

Yes, you can write a new prenuptial agreement at any time to replace the old one. The new agreement must also be registered with Skatteverket.

What happens if we don't have a prenuptial agreement?

Without a prenuptial agreement, all property is marital property and is, as a starting point, divided equally upon property division — regardless of who paid for it or who is the registered owner.

Do we need to hire a lawyer?

There is no such requirement. The important thing is that the agreement is in writing, dated, signed by both parties and registered with Skatteverket.
