What this template does

A power of attorney authorises another person — the attorney-in-fact — to act on your behalf in specific or general matters. This can include collecting deliveries, managing bank accounts, or representing you in a particular situation.

Without a written power of attorney, it can be difficult or impossible for someone else to act on your behalf. A clear power of attorney minimises the risk of misunderstandings and gives third parties confidence that they are dealing with an authorised representative.

When do you need a power of attorney?

You need this if…

  • You are travelling abroad and need someone to handle your affairs
  • You want a family member to collect deliveries or manage bank matters
  • You need to be represented in a transaction, e.g. buying or selling property
  • You are ill or unable to attend a specific event in person
  • You run a business and need to delegate decision-making authority

You might not need this if…

  • You can attend in person and handle the matter yourself
  • You need a future power of attorney (framtidsfullmakt) — it has specific formal requirements and a separate format
  • You need a power of attorney for banking that your bank requires in its own format

What the power of attorney includes

The agreement covers the following areas.

Principal and attorney-in-fact

  • Full details of the person granting the power of attorney (name, personal ID number, address, phone)
  • Full details of the person receiving the power of attorney

Scope of authority

  • Choice between general power of attorney (broad authority), delivery-collection, or specific power of attorney with a custom purpose
  • Free text to describe the exact assignment for specific powers of attorney

Validity period

  • Start date for the power of attorney
  • Optional end date or valid until revoked

Signature and witnessing

  • Principal's signature
  • Witnessing by two witnesses with contact details

Important considerations

  1. A general power of attorney grants broad authority. Only use it if you fully trust the attorney-in-fact — it gives the right to manage bank funds and represent you in all matters.
  2. The power of attorney can be revoked at any time by the principal. Notify the attorney-in-fact and any relevant third parties in writing.
  3. Some institutions (banks, government agencies) may require a power of attorney in their own format. Check this in advance.
  4. This is a regular power of attorney — not a future power of attorney (framtidsfullmakt). A future power of attorney takes effect if you lose the ability to manage your affairs and has specific formal requirements.
  5. Witnessing strengthens the evidentiary value of the power of attorney, even though it is not always a legal requirement.

Legal validity

A written power of attorney is valid in Sweden without requirements for witnessing or registration, but witnessing is recommended to strengthen evidentiary value.

The power of attorney is valid from the date specified and until it is revoked or the end date passes.

The rules on power of attorney are found in the Swedish Contracts Act (1915:218). The principal is responsible for actions performed by the attorney-in-fact within the scope of the power of attorney.

Frequently asked questions

What is the difference between a power of attorney and a future power of attorney?

A regular power of attorney takes effect immediately and can be revoked. A future power of attorney (framtidsfullmakt) only takes effect if you lose the ability to manage your own affairs, and has specific formal requirements.

Can I limit what the attorney-in-fact may do?

Yes, you can write a specific power of attorney that only applies to a particular purpose, for example signing a specific contract or collecting a specific delivery.

Does the power of attorney need to be witnessed?

It is not a legal requirement for most powers of attorney, but witnessing is strongly recommended. It strengthens the evidentiary value if the power of attorney is challenged.

Can I revoke the power of attorney?

Yes, the power of attorney can be revoked at any time by the principal. Notify the attorney-in-fact and any affected third parties in writing.

Do all banks accept a custom power of attorney?

No, many banks require their own power of attorney form. Check with your bank in advance if you need the power of attorney for banking matters.
