Important considerations

  1. Document the item's condition at handover carefully — ideally with photos as an appendix. This is the most important evidence in any later dispute over wear or damage.
  2. Set deposit and contractual penalties in reasonable proportion to the rent and the value of the item. Excessive amounts may be adjusted under section 36 of the Swedish Contracts Act.
  3. Renting out a vehicle normally requires specific rental insurance. Check that your policy covers rental before signing the agreement.
  4. When renting to consumers, parts of the Swedish Consumer Services Act and Consumer Sales Act apply — certain disclaimers will then not be valid.
  5. Commercial rental may be subject to VAT on the rent. State clearly whether the price is inclusive or exclusive of VAT.
  6. Keep the agreement and all annexes for at least three years — that is the general limitation period for claims between the parties.

Legal validity

Under Swedish law, an agreement on the rental or loan of personal property is free of formal requirements — neither written form nor witnesses are required for validity. A signed written agreement does, however, have significantly stronger evidential value in a dispute.

Frequently asked questions

Does the agreement have to be in writing to be valid?

No. Oral agreements on the rental of personal property are binding, but a written agreement is always preferable for evidential reasons. In a dispute, the party asserting a term must prove it.

How much deposit can I require?

There is no statutory cap, but the deposit should be in reasonable proportion to the value of the item and the risk of damage. A common approach is to set it equal to the insurance deductible or 10–30% of the replacement value.

What applies if the renter damages the equipment?

The renter is liable to compensate the owner for proven negligence, mishandling or lack of supervision. Normal wear from careful use does not give rise to liability. The insurance clause sets out how the deductible and any insurance pay-out are allocated.

Are the contractual penalties always enforceable?

Contractual penalties are generally enforceable but may be adjusted under section 36 of the Swedish Contracts Act if they appear unreasonable. Set the amounts in reasonable proportion to the rent and to the actual loss caused by the breach.

Can I rent out my car with this agreement?

Yes, but first check that your motor insurance allows private rentals. Many standard policies do not cover renting out for compensation — a specific short-term or add-on insurance may be required.

What happens if the renter does not return on time?

Late-return penalties under the agreement apply per hour and per day up to the agreed cap. For a delay exceeding 24 hours the owner is also entitled to full damages for lost income. In serious cases (unlawful taking), a police report can be filed.

Does the agreement need to be witnessed?

No, witnesses are not required for validity. Digital signing provides a traceable signature log and works very well as evidence. A handwritten signature in two identical copies is also sufficient.
