What this template does

Important things to consider

  1. Parents have a joint duty of maintenance under chapter 7 of the Children and Parents Code — the amount shall be in reasonable proportion to the parents' finances and the needs of the child.
  2. Försäkringskassan can provide guidance on a reasonable level based on your incomes and living arrangements.
  3. With shared residence no maintenance is normally payable, but an equalising payment may still be agreed.
  4. Indexation under the Act (1966:680) protects the amount from being eroded by inflation.
  5. Maintenance ceases when the child turns 18, but is extended if the child is still in compulsory or upper-secondary school — at the latest until age 21.
  6. The agreement does not replace Försäkringskassan's maintenance support if you do not handle the payments yourselves.
  7. Under chapter 7, section 7 of the Children and Parents Code the agreement must be in writing and witnessed by two persons to be valid for lump-sum payments or periods longer than three months.

Legal validity

Agreements on child maintenance between parents are valid under the Children and Parents Code (1949:381). A written agreement is strong evidence of what you have agreed and makes both ongoing payments and any handling by authorities or courts easier.

Frequently asked questions

Does the agreement have to be in writing to be valid?

Oral agreements on child maintenance are in principle valid but hard to prove. A written agreement is strong evidence of what you have agreed and makes contact with Försäkringskassan, the Swedish Tax Agency and any court easier. For lump-sum payments or periods longer than three months at a time the law requires the agreement to be in writing and witnessed by two persons.

How large should the maintenance be?

The amount is set based on the child's needs and the parents' finances under chapter 7 of the Children and Parents Code. Försäkringskassan has a calculation model that is often used for guidance. You are free to agree on a different amount as long as it is reasonable.

What does indexation mean?

Indexation means that the amount is adjusted each year under the Act (1966:680) on the amendment of certain maintenance payments, which is linked to the price base amount. This protects the recipient from the amount being eroded by inflation over time.

When does the duty of maintenance end?

The duty ends when the child turns 18. If the child is still in compulsory or upper-secondary school, it is extended until those studies are completed, but at the latest until age 21.

What happens if the paying parent does not pay?

The receiving parent can apply for maintenance support from Försäkringskassan, which can then claim the amount back from the paying parent. If non-payment continues, the claim can be enforced through the Swedish Enforcement Authority (Kronofogden).

Can the agreement be changed later?

Yes. The parents can at any time jointly agree to raise, lower or otherwise change the maintenance if circumstances change — for example following a change in income or living arrangements. The change should be documented in writing.
